Terms and Conditions of Use

FCTECH Last updated: April 2026 This document sets forth the Terms and Conditions that govern access to, use of, and contracting of the services offered by FCTECH (hereinafter “the Provider”), through its websites and digital platforms, including monitor.fctech.com.mx. By accessing, browsing, or subscribing to any of our services, the user (hereinafter, “the User”) expressly accepts these Terms and Conditions.

1. Supplier Information

FCTECH is a company specializing in technology consulting, managed services, monitoring solutions, licensing, and digital platforms, operating in accordance with the applicable laws of the United Mexican States, in compliance with the Federal Consumer Protection Act. [diputados.gob.mx]

2. Acceptance of the Terms

Use of FCTECH's websites, platforms, or services implies:
  • Full acceptance of these Terms and Conditions.
  • The recognition that contracts entered into electronically are fully legally valid under the Mexican Commercial Code. [marketb2b.mx]
If the User does not agree to these terms, they must refrain from using the services.

3. Services Offered

FCTECH offers, among other things:
  • Software-as-a-Service (SaaS) digital platforms, such as Cloud Monitor.
  • Managed services, consulting, support, and monitoring.
  • Licenses, subscriptions, and technology plans.
The features, scope, prices, and specific terms are detailed in each proposal, contract, or published plan.

4. Proper Use of the Platform

The User agrees to:
  • Use the services lawfully and in accordance with the law.
  • Do not engage in any actions that could compromise the availability, security, or integrity of the systems.
  • Do not use the platform for illegal, fraudulent, or unauthorized purposes.
FCTECH reserves the right to suspend or revoke access in the event of misuse.

5. User Registration and Responsibility

The User is responsible for:
  • Provide accurate and up-to-date information.
  • Keep your login credentials safe.
  • All activity performed from your account.
Any unauthorized use must be reported immediately to FCTECH.

6. Payments and Billing

  • Prices are listed in Mexican pesos (MXN), unless otherwise noted.
  • Payments must be made in accordance with the terms of the plan you have purchased.
  • For recurring services, the User authorizes automatic charges in accordance with the selected payment plan, subject to their right to cancel under the LFPC. [derechomex…ano.com.mx]

7. Cancellations, Refunds, and Returns

Cancellations and refunds are governed by the Refund and Return Policy published by FCTECH, in strict compliance with the Federal Consumer Protection Law. [diputados.gob.mx]

8. Intellectual Property

All content, software, trademarks, logos, documentation, design, and materials available on FCTECH’s websites are the exclusive property of the Provider or are licensed by the Provider. Unauthorized reproduction, distribution, or use is prohibited.

9. Service availability

FCTECH makes reasonable efforts to ensure the availability of its platforms; however, the User acknowledges that:
  • Service interruptions may occur due to maintenance, upgrades, or other reasons beyond our control.
  • We cannot guarantee 100% uninterrupted operation.

10. Limitation of Liability

FCTECH shall not be liable for:
  • Damage resulting from improper use of the platform.
  • Failures caused by third parties, external providers, or user configurations.

11. Protection of Personal Data

The processing of the User's personal data is governed by the Privacy Notice by FCTECH, in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties.

12. Amendments

FCTECH may update these Terms and Conditions at any time. Any changes will be posted on the relevant website and will take effect upon publication.

13. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the United States of Mexico. In the event of any dispute, the parties agree to submit to the jurisdiction of the Mexican authorities and, where applicable, to the PROFECO, in accordance with the LFPC.
